Documentations for O.C.P.I. technical reception
We provide services of land surveying and preparation of cadastral documentation required for first registration of real estate properties in the Land Book, update of technical records, land plots consolidation/ division, recording of new constructions in case of real estate properties already registered in the Land Book (tabulated), both for legal entities or individuals.
In case of individuals we provide cadastre and land registration services for the following types of properties: apartment, land free of constructions, land with constructions (land within or outside built-up area) etc.
In case of legal entities, we provide cadastre and land registration services for a wider range of properties. Thus, in addition to the type of properties mentioned above, we also do cadastre works for roads (e.g. first registration in the Land Book of county roads, village or town streets etc.), artificial lakes and their specific hydro technical constructions (e.g. dams, embankments, bridges, pumping stations etc.), forests, industrial parks, residential areas (e.g. apartment buildings), as well as for any other type of real estate property.
All the topographic and cadastre services we provide are undertaken by our personnel using latest GNSS equipment, total stations, levels, telemeters etc. that ensure a high accuracy of the topographic surveys.
Cadastral documentations
Within these services, our company performs topographic surveys, processes the data collected in the field and prepares the cadastral documentation, including the location and boundary plan (P.A.D.) and / or floor survey plans, as appropriate, for:
- First registration of the property in the Land Book (property tabulation) (apartment, land free of constructions, land with constructions etc.)
First registration of a real estate property in the integrated Cadastre and Land Registration Information System is the operation by which the property geometry information together with property legal status information (ownership, encumbrances etc.) are registered in a new land book, which is to be kept and updated by the Cadastre and Land Registration Office of the county where the real estate property is located. There is a Cadastre and Land Registration Office in every county in Romania.
After analyzing the property deeds and owners’ documents provided, we let you know whether you need to bring more documents or not, and which of the presented documents must be provided to us in the form of copies authenticated by a notary public or originals.
We go to the location indicated by the client, we do the topographic surveying, and then we draw the Location and Boundary Plan (P.A.D.) or the apartment floor plan, by case.
When we have all the required deeds and documents, we prepare the cadastral documentation for first registration and we submit it to the Cadastre and Land Registration Office for their approval, with a regular or emergency deadline, depending on the client’s choice.
After the documentation is approved by the Cadastre and Land Registration Office, we take it from there and deliver it to the client. The approved documentation consists of the following:
- Land Registrar Decision;
- Land Book excerpt for information;
- Location and Boundary Plan (P.A.D.) endorsed by the Cadastre and Land Registration Office
- Updating the technical information existing in the Land Book like registration of new constructions, registration of extension/ demolition of constructions, registration of new postal address when it changes etc.
This operation involves registering with the integrated Cadastre and Land Registration Information System (e-Terra) of any changes regarding an already registered real estate property.
Depending on the type of property technical information that must be updated and following the analysis of the clients’ documents, we decide whether we need or not to request further information from the Cadastre and Land Registration Office with regard to the respective property, as well as to what documents are to be provided in original or authenticated copy or if the owner needs to bring additional documents.
We go to the location indicated by the client, we do the topographic surveying, and then we draw the Location and Boundary Plan (P.A.D.).
In the next step we analyze the information provided by the Cadastre and Land Registration Office together with resulted Location and Boundary Plan (P.A.D.) and the owner’s documents, and then we decide on the content of the cadastral documentation.
The cadastral documentation for updating the technical information will be submitted to the Cadastre and Land Registration Office to be approved within a regular or emergency deadline, depending on the client’s choice.
After the documentation is approved by the Cadastre and Land Registration Office, we take it from there and deliver it to the client. The approved documentation consists of the following:
- Land Registrar Decision;
- Land Book excerpt for information;
- Location and Boundary Plan (P.A.D.) endorsed by the Cadastre and Land Registration Office
Note: For registration of new constructions or constructions’ extension/ demolition, there are required at least the following documents:
- Existing cadastral documentation (Location and Boundary Plan – P.A.D.) – copy
- Land Book excerpt for information
- Permit for Constructing or Permit for Extending/ Demolishing of a Building – notarized copy
- Delivery Protocol upon Completion of Construction Works – notarized copy
- Energy Performance Certificate with the issue date before the date of the Delivery Protocol upon Completion of Construction Works (notarized copy or original).
- Building Erection Certificate issued by the Mayor’s office – notarized copy
- Confirmation of the postal number– original/ notarized copy
- Owner’s Identity Card (individuals)/ Unique Registration Number – C.U.I. (legal entity) – copy
- Registration in the Land Book of land plots consolidation/ division
Consolidation is the operation of unifying of two or more adjacent real estates, and the resulted real estate is registered with the integrated Cadastre and Land Registration information system.
Division is the operation whereby one real estate is split in two or several units, and the resulted real estates are given a unique cadastral number and then registered with the integrated Cadastre and Land Registration information system, in separate land books.
In order to do these two operations the following conditions must be met:
- The respective real estates must be already registered with the integrated Cadastre and Land Registration information system, and
- There must be no overlapping with adjacent properties, which are also registered with the integrated Cadastre and Land Registration information system.
Following the analysis of the clients’ documents, we decide what kind of information we need to request from the Cadastre and Land Registration Office with regard to the respective property/ properties and whether there is necessary or not to prepare, as a first step, cadastral documentation for first registration.
We go to the location indicated by the client, we do the topographic surveying, and then we draw the Location and Boundary Plan (P.A.D.).
In the next step we analyze the information provided by the Cadastre and Land Registration Office together with resulted Location and Boundary Plan (P.A.D.), and we determine if we need to prepare a cadastral documentation for updating the technical information or for correcting the property area or boundaries in order to eliminate overlapping with adjacent cadastral numbers.
After we make sure the above two conditions for achieving property consolidation/ division are met, we prepare and submit the respective cadastral documentation for the Cadastre and Land Book Office’s approval.
These are “interrupted flux” operations because after the resulted Location and Boundary plan/ plans are approved by the cadastre inspector from the Cadastre and Land Book Office, we deliver the plan/ plans to the client, which in turn goes to a Notary Public for preparation of an authenticated deed for property consolidation/ division. Then the notary submits the deed for registration with the Land Book.
Note: In case of dividing a property in more than 2 (two) lots, it is required to include in the cadastral documentation of an Urban Planning Permit for property division.
- Correction of wrong cadastral records in the cadastral and land registration information system in order to re-position the property, to correct the property boundaries, to correct a clerical error etc.
Rectification operation for a property already registered with the integrated Cadastre and Land Registration information system, as the name suggests, is referring to the correction of the information from the cadastral and/or land book records regarding the specific property.
Usually this type of operation is required when the client’s cadastral documentation is prepared in a local projection system or when there are some errors or overlapping with adjacent properties (cadastral numbers).
The cadastral documentation for rectification will be submitted for the approval of Cadastre and Land Book Office with a regular or emergency deadline, depending on the client’s choice.
